In eerste aanleg had hij daarvoor nog één jaar cel en 5.500 euro boete gekregen, beiden met uitstel. Vandaele reageerde zichtbaar opgelucht na de uitspraak.
Hij was tussen 15 mei 2001 en 31 december 2008 korpschef van Mechelen en bleef daarna nog tot 12 mei 2009 waarnemend korpschef. Hij cumuleerde die taak met de functie van directeur van de lokale recherche en liet zijn overuren en weekendwerk uitbetalen in plaats van te opteren voor de vaste vergoeding voor het hoogste ambt.
Voor het cumuleren van de twee functies werd hij zowel in eerste aanleg als in beroep vrijgesproken, omdat geen enkele wet dat verbiedt. Er bestaat evenmin een wettelijke verplichting om te kiezen voor de weddetoeslag voor het hoogste ambt.
De rechter in eerste aanleg was wel gestruikeld over de 546 euro aan recherchevergoedingen die hij had opgestreken. Vandaele had burgemeester Bart Somers op 9 september 2008 een document laten ondertekenen, waarin stond dat hij aan zijn nieuwe functie een operationele invulling zou geven. Alleen was dat volgens de eerste rechter geen operationele, maar een beheersfunctie. Hij mocht dus geen aanspraak maken op die vergoeding en bezondigde zich aan schriftvervalsing en oplichting.
De rechters in beroep waren het daar niet mee eens: de functie van directeur van de lokale recherche kan wél een operationele invulling hebben, die recht geeft op de recherchevergoeding. Het bedrieglijk opzet van Vandaele was volgens het hof niet bewezen, waardoor hij ook daarvoor werd vrijgesproken.
